1. Provider, scope and contract formation

These Terms govern the Lumio app, Lumio API and related account functions (together, "Lumio"). The provider is Dr. Stephan Tilke, Sollnerstr. 82, 81479 Munich, Germany, acting as an individual. Contact: lumioapps.de@gmail.com.

The agreement is formed when you expressly accept these Terms in the app and Lumio activates your account or access. This also applies to guest accounts. The Privacy Policy provides information about data processing; acknowledging it is not consent to processing that requires separate consent.

2. Service

Lumio offers general content and tools for mindfulness, meditation, breathing exercises, mood and journal tracking, courses and algorithmic insights. We do not promise any particular personal, health or financial result. Automated insights and recommendations are based on limited input, may be incomplete or incorrect and must be independently assessed before important decisions.

While Lumio is provided, we supply the updates, including security updates, that are legally required to maintain conformity and inform you about them. You should install supplied updates promptly; the legal consequences of failing to install an update are governed by applicable law.

Changes beyond maintaining conformity are made only for a valid reason, including new technical requirements, security threats, changes in law or adaptation to changed user needs, without additional cost and subject to statutory information, remedy and termination rights. If a change negatively affects access or usability beyond a minor degree, we will provide clear and timely information on a durable medium. Mandatory rights for digital products remain unaffected.

3. Not a substitute for professional help

Lumio supports general self-reflection and personal development. Lumio is not a medical device, therapy, diagnosis, emergency or crisis service, or medical, psychotherapeutic, legal or financial advice.

In case of acute symptoms, crisis, risk of harm to yourself or others, do not rely on Lumio. Contact qualified professionals or local emergency services immediately — in Germany that is 112, and free confidential support is available around the clock from Telefonseelsorge on 0800 111 0 111 or 0800 111 0 222 (also online at telefonseelsorge.de). If you are elsewhere, use your local emergency number and crisis helpline. Stop breathing, meditation or mindfulness exercises if you experience pain, severe dizziness, shortness of breath or other significant discomfort and seek medical advice where appropriate.

4. Responsible use

You are responsible for deciding whether content or exercises are suitable for your personal situation. Do not use Lumio as the sole basis for important health, legal, financial or safety-related decisions. Lumio content is general guidance, not individually reviewed instructions.

5. Account, access security and age

You must keep your details accurate and current. Protect your password, passkey, recovery code and devices from third-party access and notify us of suspected misuse. You are responsible for account activity to the extent it is attributable to you.

Use is permitted from age 13. Minors require consent from a parent or guardian where required by applicable law. Guardians should supervise whether the content is appropriate.

6. Acceptable use

You agree not to manipulate your account, bypass security checks or obtain coins, course unlocks, tickets or other features through modified app code, automated requests or similar abuse. Valuable actions are verified server-side and may be blocked or corrected if abused.

You must not use Lumio unlawfully, abusively, to harm others, overload the service, spread malware or infringe third-party rights.

7. Free use

Lumio is currently provided free of charge. No new paid subscriptions or in-app purchases are currently offered. If Lumio introduces paid offerings in the future, the price, duration, cancellation and other terms will be clearly shown before purchase. Subscriptions previously purchased through the Apple App Store or Google Play must still be managed or cancelled in the respective store.

8. Availability, synchronization and data loss

We aim for secure and stable operation but do not promise uninterrupted availability, a particular response time or permanently error-free synchronization. Maintenance, updates, incidents, failures of internet or platform services, security measures and events outside our reasonable control may temporarily limit Lumio.

Lumio is not a service specialized in permanent archival. Despite reasonable safeguards, local or synchronized data can be lost through device loss, user action, account deletion or technical incidents. Use the export function and your own backups if content is important to you. If end-to-end encryption is enabled, we cannot technically recover encrypted content without your password or recovery code. Statutory remedies for a failure to provide a conforming digital product remain unaffected.

9. Information security

We use appropriate technical and organizational safeguards. No internet-connected system can provide absolute security, and cyberattacks, unauthorized access or previously unknown vulnerabilities cannot be completely ruled out even with reasonable safeguards. We investigate and handle security incidents as required by law. This statement does not limit your statutory privacy or compensation rights.

10. Third-party services

Some functions depend on operating systems, app stores, internet access, email delivery or other third-party services. Their providers are responsible for their independent services, availability and terms. We are liable for third-party service failures only to the extent required by applicable law.

11. Rights of use

The app, design and content provided by Lumio are legally protected. For the duration of the agreement, you receive a limited, non-transferable right for personal, non-commercial use. Your journal and other user content remain yours; you grant us only the rights technically necessary to provide the functions you choose.

12. Liability

Lumio is provided free of charge. For such gratuitous provision, the statutory privileged standard of liability under Sections 521 and 599 of the German Civil Code applies accordingly: in that respect we are answerable only for intent and gross negligence. The following paragraphs apply in addition and, where the statutory privilege does not apply in an individual case, in its place.

We are fully liable for intent and gross negligence, culpable injury to life, body or health, and all cases of mandatory statutory liability.

For ordinary negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for proper performance of the agreement and on which users may normally rely. In that case, liability is limited to the foreseeable, contract-typical loss at the time of contract formation.

Liability for ordinary negligence is otherwise excluded. These limitations also apply for the benefit of our legal representatives and agents. Mandatory claims, including under product liability law and applicable data protection law such as Article 82 GDPR, remain unaffected. Statements about functions, security or availability are warranties only if expressly identified as such.

13. Suspension and termination

You may delete your account at any time in settings or through the online account center. We may temporarily suspend access where necessary to address concrete security risks, prevent abuse or comply with legal obligations. We may terminate for cause in case of a serious breach of these Terms. Statutory termination rights remain unaffected.

14. Changes to these Terms

We may update these Terms where new functions, security requirements or changes in law require it. Editorial or exclusively beneficial changes may apply immediately. For material changes, we will request your express acceptance in the app before they take effect. Without acceptance, you may be unable to continue using Lumio and may terminate your account.

15. Law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident outside Germany, mandatory consumer protections of your country remain unaffected.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final provisions

If individual provisions are not incorporated or are invalid, the remainder of the agreement remains effective and the statutory rules apply.
